1.1 These Terms of Service govern your use of the OnfliQ Smart Dining Hub, available at www.onfliq.com, and any associated digital platforms we operate.

1.2 By accessing or using the OnfliQ Smart Dining Hub, you agree to these terms in full. If you do not agree, you may not access or use the platform.

1.3 If you register an account, place an order, submit any information, or access any of our services, you may be required to expressly accept these terms.

1.4 You must be at least 16 years old to use our services. By using the platform, you confirm you meet this age requirement.

1.5 This platform uses cookies. By using our services, you consent to our use of cookies as described in our Privacy Policy.

4. License to Use the Platform

4.1 You may:

  • View, interact with, and use services offered on our platform for personal or business dining purposes.

  • Download or print content for record-keeping, order management, or administrative use.

4.2 You may not:

  • Reproduce, republish, or redistribute material from the platform without written permission.

  • Modify, edit, or adapt platform content without authorization.

  • Use any content for resale or commercial redistribution.

4.3 We reserve the right to restrict access to certain areas or features at our discretion.


5. Acceptable Use

5.1 You must not:

  • Use the platform in any way that is unlawful, fraudulent, or harmful.

  • Upload or introduce viruses, malware, or malicious code.

  • Extract or harvest user data without permission (e.g., via scraping).

  • Use bots or automation (excluding search engines or authorized services) to interact with the platform.

5.2 All information submitted must be accurate, up to date, and not misleading.


6. Registration and Accounts

6.1 Registration is required for restaurant partners and optional for diners.

6.2 Users must:

  • Keep login credentials secure.

  • Notify us immediately of any unauthorized access or suspicious activity.

6.3 We reserve the right to suspend or terminate accounts that violate these terms or compromise service integrity.


7. Payments

7.1 Payments may be made via Visa, MasterCard, Diners Club, American Express, or bank transfer. Details will be provided at checkout or upon request.

7.2 Payments are securely processed by Peach Payments. No card information is stored on our servers. For more information, visit www.peachpayments.com.


8. Creator Partner SLA (Service Level Agreement)

8.1 Platform Availability

We aim for 99.5% uptime for your LinkCard storefront and dashboard, excluding scheduled maintenance and force majeure events.

8.2 Onboarding & Support

Your LinkCard store will be created within 3 business days upon receiving the required information and assets.
Support is available via email and live chat (Mon–Fri, 9 AM – 6 PM GMT+2).
Critical platform issues may be escalated for 24/7 assistance.

8.3 Order Processing & Payment Settlement

Orders made through your LinkCard store are processed in real time.
Earnings are settled within 2–5 business days after successful transactions.
Refunds and disputes are handled in accordance with our Refunds & Disputes Policy.

8.4 Roles & Responsibilities

Creators:

  • Keep your store information up to date

  • Promote your LinkCard responsibly

  • Engage with your community professionally

LinkCard:

  • Ensure your store is functional, secure, and optimized

  • Provide support, reporting tools, and regular updates

  • Handle logistics with listed product suppliers (where applicable)

8.5 Termination of Service

LinkCard may suspend or deactivate accounts in cases of misconduct, repeated violations, or brand misalignment.
Creators may request termination with 30 days’ written notice.


9. Limited Warranties

9.1 We do not guarantee:

  • The absolute accuracy of all content (e.g., menu items, pricing).

  • Continuous availability of all platform features.

9.2 We may update, modify, or discontinue features at any time without prior notice.


10. Limitations of Liability

10.1 These terms do not limit liability for:

  • Death or personal injury due to negligence.

  • Fraud or fraudulent misrepresentation.

10.2 We are not liable for:

  • Losses of profits, data, or business opportunities.

  • Interruptions caused by external systems, internet outages, or cyber threats.


11. Breaches of Terms

11.1 If these terms are breached, we may:

  • Issue formal warnings.

  • Suspend or delete user accounts.

  • Pursue legal action if necessary.


12. Third-Party Rights

12.1 These terms are between you and us. No third party has any rights under them.


13. Governing Law & Jurisdiction

13.1 These terms are governed by the laws of South Africa.

13.2 Any disputes will be handled by South African courts.
